1.1. DEFINITIONS
1.1.1. Company Night Run — means an event consisting of the competitive kilometers covered by the Participants as part of a given Team, held on June 13, 2025 in Warsaw, at the Sluzewiec Circuit, under the conditions specified in the Regulations;
1.1.2. Civil Code — Act of 23 April 1964 — Civil Code (consolidated text: Journal of Laws of 2020, item 1740, as amended);
1.1.3. Privacy Policy — means a document called “Privacy Policy” available for download on the Website at https://biegfirmowy.pl;
1.1.4. Regulations — means these “Regulations of the Company Night Night Run 2025” available for download on the Website at https://biegfirmowy.pl/;
1.1.5. Terms of Service — means “Terms of use of the biegfirmowy.pl website” available for download on the Website at https://biegfirmowy.pl/;
1.1.6. Website — means the Website located on the Internet available at https://biegfirmowy.pl/nocny-bieg-firmowy// and all functions and tools available through this Website;
1.1.7. Company — means a natural person conducting business activity, a legal person, an organizational unit without legal personality submitting the registration of Teams participating in the Company Night Run;
1.1.8. Organizer — means the Everest Foundation with its registered office in Wrocław, ul. Wielka 67, 53-340 Wrocław, entered in the register of associations, other social and professional organizations, foundations and independent public healthcare institutions of the National Court Register maintained by the District Court for Wrocław — Fabryczna, VI Commercial Division of the National Court Register under KRS No.: 0000443682, having No. REGON: 022032388, and NIP number: 894-304-34-29.
1.1.9. Participant — means an adult natural person registered as a Participant of the Company's Night Night Run by the Company, who has confirmed participation in the Company Night Run and accepted the Regulations of the Company Night Run;
1.1.10. Team — means a team submitted by the User on behalf of the Company, consisting of 5 Participants;
1.1.11. Starter package — means the purchased package allowing participation in the Company Night Run. 
1.2. DESCRIPTION OF THE EVENT
1.2.1. The Company Night Run is charitable and takes place on June 13, 2025 under the conditions set out in these Regulations.
1.2.2. Participants take part in the Company Night Run as a team on the site of the event.
1.2.3. The race is an event organized in one place and time, it constitutes a mass event within the meaning of the provisions of the Act of 20 March 2009 on the safety of mass events (i.e. Journal of Laws of 2019, item 2171 as amended).
1.3. THE PURPOSE OF THE CORPORATE NIGHT RUN1.3.1. Charitable purpose — the proceeds from the run will be used for treatment, rehabilitation or rehabilitation equipment for the Everest Foundation beneficiaries.
1.3.2. Promoting running as an excellent form of physical activity and a healthy lifestyle,
1.3.3. To allow you to test your capabilities in comparison with other Participants. 
1.4. ORGANIZER
1.4.1. The organizer of the Company Night Run is the Everest Foundation with its registered office in Wrocław, ul. Wielka 67, 53-340 Wrocław, entered in the register of associations, other social and professional organizations, foundations and independent public health care institutions of the National Court Register maintained by the District Court for Wrocław — Fabryczna, VI Commercial Division of the National Court Register under KRS no.: 00004444 3682, having REGON number: 022032388, and NIP number: 894-304-34-29.


2.1. CONDITIONS OF PARTICIPATION
2.1.1. The Company Night Run is attended by Teams consisting of 5 Participants registered on behalf of the Company, under the conditions specified in the Terms and Conditions of the Service. Any number of Teams can apply from one Company.
2.1.2. The condition for the Participant's participation in the Company Night Run is:
— registration of the Participant as part of the Team submitted by the Company on the Website;
— appearing at the start
— acceptance of the content of the Race Regulations
2.1.3. Upon completion of registration, the Participant will be able to edit his registration data within the deadlines specified by the Organizer under the rules specified on the Website.
2.1.4. The right to participate in the Company Night Run is vested in a specific person and cannot be transferred, with the exception of changes made by a person acting on behalf of the Company within the Service.
2.1.5. Each Participant will be covered by the NNW insurance concluded by the Organizer, but if the Participant's date of birth is not correctly indicated during the registration of the Teams during the registration of the Teams, the Organizer reserves that it will not be possible to cover such Participant's insurance, for which the Organizer is not responsible. The Organizer is not obliged to take additional steps to obtain the correct date of birth from Participants who did not indicate it during the registration.
2.1.6. By accepting the Race Regulations, by appearing at the start of the race in order to participate in the Company Night Run, the Participant declares that his state of health allows him to participate in the Company Night Run and starts at his own responsibility, being aware of the dangers and risks arising from the nature of this event. The Organizer is not entitled or obliged to verify the veracity of the above statement and does not bear any responsibility in this regard. The Participant further declares that he is not in a situation where his participation in the Company Night Run poses a risk to the Participant or other persons or constituted a violation of the law, including related to the state of epidemic or epidemic threat. The organizer recommends a medical visit before the Company Run in order to confirm the possibility of participating in the Company Night Run.
2.1.7. By participating in the Company Night Run, the Participant accepts consent to the fixation and publication of his image, this includes its publication in materials and on information channels (including social media of the Company Night Run and the Organizer) and promotional, including in a promotional video and on the Website, in connection with participation in the event.
2.2. RULES OF PARTICIPATION 
2.2.1. Rules of participation: 
— in order to participate in the Company Night Run, each Participant is obliged to appear at the event area and the start-finish zone at the appointed time
— Participants take part in the race as a team. Each of the 5 Participants of the team runs a competitive distance along the designated running route; 
— Participants can cover the distance together or separately
— during the race, each Participant must have the race number provided by the Organizer in the starting package, pinned on the front to the start shirt. Obscure of the start number in whole or in part, or its modification is prohibited under penalty of disqualification;
2.2.2. The times achieved by individual Participants in accordance with this point constitute their individual results. Team Time is calculated as the sum of the times of all five Participants within a given Team.
2.2.3. In the event of a change in the date of the Company Night Run, a change in the Formula of the race, or its cancellation for reasons beyond the control of the Organizer, e.g. as a result of hazards, evacuation, very heavy rainfall, storm, hail, or the action of other weather conditions or an epidemic state or an epidemic state, or in connection with accepted restrictions on movement or health protection recommendations, the Participant or the Company may not demand from the Organizer the refund of the starting fee or any other costs. The Organizer will make every effort to allow participation in the Run on another date set by the Organizer.
2.2.4. The condition for inclusion of the Team in the team classification is the completion of the race by all Participants, i.e. by each of them covering the distance under the conditions specified in the Regulations.
2.2.5. Only those Teams that consist of five different Participants can stand on the podium of the Company Night Run.
2.2.6. Regardless of the team classification, an individual classification is carried out.
2.2.7. The organizer reserves the right to introduce other classifications.
2.2.8. Problems and complaints related to the results of the race should be reported on the day of the event. The Organizer reserves the right to extend the deadline for filing a complaint.
2.2.9. The organizer will announce the results within 5 working days on the website: https://biegfirmowy.pl/nocny-bieg-firmowy//wyniki/.
2.3. STARTING FEE2.3.1. The Team application is subject to a one-time entry fee. The fees for participation in the Company Night Run are respectively:
2.3.1.1. JUST RUN package in the REGULAR pool: PLN 1245 net/team; from 09.01.2025 to 28.03.2025 or when stocks are exhausted,
2.3.1.2. JUST RUN package in the LAST pool: PLN 1495 net/team; from 29.03.2025 to 18.04.2025 or when stocks are exhausted,
2.3.1.3. RUN LIKE A HERO package in the REGULAR pool: PLN 1495 net/team; from 09.01.2025 to 28.03.2025 or when stocks last,
2.3.1.4. RUN LIKE A HERO package in the LAST pool: 1745 zł Net/team; from 29.03.2025 to 18.04.2025 or when stocks last,
2.3.1.5. RUN&FUN package in the REGULAR pool: PLN 1995/team; from 09.01.2025 to 28.03.2025 or when stocks are exhausted,
2.3.1.6. The RUN&FUN package in the LAST pool: PLN 1995/team; from 29.03.2025 to 18.04.2025 or when stocks are exhausted,
2.3.2. A courier fee of PLN 49.99 net is added to each individual order.
2.3.3. The entry fee must be paid to the Administrator's bank account indicated on the invoice. The deadline for payment is 7 days from the date of issue of the invoice. In the case of a custom invoice, the payment term depends on the arrangements between the Administrator and the Company.
2.3.4. The administrator will only accept deposits in the form of a bank transfer.
2.3.5. The User agrees on behalf of the Company to receive the invoice only electronically. The administrator ensures that the invoice will be issued in accordance with the applicable requirements.
2.3.6. In case the invoice is not delivered to the specified e-mail address within 48 hours of registration and the custom invoice option has not been selected, please contact the Administrator.
2.3.7. Starter packages will be delivered by paid post or courier to the address indicated in the form in the User's account. The method of shipment is decided by the Administrator.
2.3.8. In the event of a change in the date or place of the Company Night Run, or its cancellation for reasons beyond the control of the Administrator, e.g. as a result of hazards, evacuation, very heavy rainfall, storm, hail or other weather conditions or an epidemic state or in connection with accepted restrictions on movement, organization of events or recommendations in the field of health protection, the Participant or the Company may not demand from the Administration Refund of the entry fee or any other costs. The Administrator will make every effort to enable participation in the Run on another date set by the Administrator.
2.4. AwardsAlthough the Company Night Run has a recreational and charitable dimension, prizes are provided for the winners in the following categories:
● the fastest women's team — I, II, III place,
● the fastest men's team — I, II, III place,
● the fastest mixed team (at least one person of the opposite sex to the other players on the team) — I, II, III place,
● individual — the fastest rider I, II, III place,
● individual - the fastest racer I, II, III places.2.4.1. The organizer can enter additional prizes and categories.
2.4.2. The results that form the basis for awarding the Prizes will be determined solely on the basis of the timing of the event. No other measurement may constitute the basis for any complaint or allegation.
2.4.3. The j prizes will be distributed to the winners during the event, after the final results are announced.
2.4.4. Prizes will be distributed according to the Organizer's knowledge of the results of the race at the time. If, in the end, the results differ from those given immediately after the race, there is no right to complain about the issuance of prizes, except if the prize goes to the person who shortened the route of the race or otherwise violated the conditions of participation in the Company Night Run.
2.5. DISQUALIFICATION
2.5.1. At any time during the Company Night Run, the Organizer has the right, in its sole discretion, to disqualify and exclude any Participant who does not comply with the Terms and Conditions or violates the law or interferes with the course of the Night Company Run, his/her conduct may cause or cause damage to human health, property loss or loss of the Organizer's reputation; states untrue the information in the registration form is used on the route by a person who does not participate in the Company Night Run, as well as for medical reasons. In the event of disqualification of a Participant who is entitled to a prize, the prize is forfeited and may be donated or awarded to another Entrant. Disqualified participants will not be included in the official results.


3.1. JUST RUN PACKAGE
3.1.1. The JUST RUN packages contain commemorative medals and T-shirts with the theme of the 1st edition of the Company Night Run for Participants in the type and size indicated by the User.
3.1.2. If the User does not fill in the data on the type and size of the T-shirt for the ordered package within the deadlines mentioned in the regulations, the Administrator does not guarantee delivery of the Just Run Package before the start of the event on the day appointed by the Organizer on June 13, 2025.
3.1.3. Visualization of the T-shirt template is available in the Information Service.3.2. RUN LIKE A HERO PACKAGE
3.2.1. RUN LIKE A HERO packages contain commemorative medals and personalized T-shirts with the Company logo for Participants, in the type and size indicated by the User.
3.2.2. The User acting on behalf of the Company is obliged to send by e-mail his logo/logo of the company in CDR, PDF, EPS format in high quality.
3.2.3. The submitted logo will be placed on the T-shirt design in a rectangle 17 x 23 cm at chest height.
3.2.4. The visualization of the T-shirt template is available in the Information Service.
3.2.5. If the User does not provide the required materials within the deadlines mentioned in the regulations, the Administrator does not guarantee delivery of the Run Like a Hero Package before the start of the event on the date set by the Organizer on June 13, 2025.
3.3. RUN&FUN PACKAGE
3.3.1. RUN&FUN packages contain commemorative medals and personalized T-shirts with the Company logo for Participants, in the size indicated by the User.
3.3.2. The RUN&FUN package allows the Participant to enter the Silent Disco event organized after the run.
3.3.3. The User acting on behalf of the Company is obliged to send by e-mail his logo/logo of the company in CDR, PDF, EPS format in high quality.
3.3.4. The user acting on behalf of the Company is obliged to send by e-mail information regarding the Pantone colors contained in the logo/marking. In the absence of Pantone colors, the Administrator reserves the reservation that the colors of the logo/marking placed on the T-shirt may differ slightly from the submitted artwork.
3.3.5. The submitted logo will be placed on the T-shirt design in a rectangle 17 x 23 cm at chest height.
3.3.6. The visualization of the T-shirt template is available in the Information Service.
3.3.7. If the User does not provide the required materials within the deadlines mentioned in the regulations, the Administrator does not guarantee the delivery of the RUN&FUN Package before the start of the event on the day appointed by the Organizer on June 13, 2025.

The starting package allows entry to the event area of the Company Night Run 2025 on the day appointed by the Organizer on June 13, 2025. The user who purchased the packages has the opportunity to change the data of the Participants within the deadline set by the Organizer. However, the Administrator does not guarantee the appropriate size and type of shirts for changes made after the time.3.4. COMPLAINTS
3.4.1. Complaints related to T-shirts or medals received as part of the ordered Packages must be submitted within 5 working days from the date of receipt of the Package.
3.4.2. Complaints will be considered within 14 working days from the date of submission of the complaint.
3.4.3. The complaint must be submitted by contacting the Administrator at the e-mail address: biuro@biegfirmowy.pl and completing the form received through this communication. 


4.1. CAVEATS
4.1.1. The Participant acknowledges and accepts that the Organizer will not carry out any additional verification of the achieved results, recorded using the Application and the measurement of time at the stationary event, which are the only source of information in this regard for the purposes of the Company Night Run. The Participant further accepts that each route covered by each Participant may differ from each other in terms of difficulty and attainable time, and that the results achieved may also be affected by the start and end times of the race or the weather conditions in individual locations.
4.1.2. The Organizer does not bear any responsibility for defects in the operation of the Application, regardless of their causes.
4.2. FINAL PROVISIONS
4.2.1. These terms and conditions apply to all Participants of the Company Night Run. Confirmation of participation in the race is equivalent to familiarization with these regulations and their acceptance.
4.2.2. The Organizer is entitled to change the Rules of the Race at any time, of which he will inform the Participants by means of the Website and by posting the changed content on the Website. Such amendment shall enter into force 14 days after its announcement in the above manner. In case of non-acceptance of the changes, the Participant will not be entitled to participate in the Company Night Run on the date appointed by the Organizer on June 13, 2025.
